Holland Conservation Commission

Minutes of Commission meeting held on May 16, 2006.

Present: Mary vandenBerg, Chairperson, Patricia Caron, Howard Fife, Ann Hall, Rolf Hilbig and James Wettlaufer. Absent: Steven Anderstrom.

7:00 p.m. Chairperson called the meeting to order.

7:05 p.m. Minutes of Commission Meeting held on May 9, 2006 were read, accepted and will be distributed.

7:08 p.m. On May 10, 2006 R.J. Perron, contractor, was called - left a message that we would require Mr. Frigo’s Notice of Intent by Thursday, 5-11-06 in order to place his Legal Ad for the Public Hearing scheduled for May 23, 2006 to add a second floor to existing structure at 12 Julie Ann Dr. Mr. Perron replied that evening requesting an extension until June 13, 2006 at 7:30 p.m.

On May 11th, Laurie Kennedy alerted Steven Anderstrom about equipment going in and out for perc tests and disturbing considerably the area on Alexander and Allen Hill Rds. Steven brought it to our attention and requested agent Howard Fife to investigate. Howard Fife, Agent, Selectmen James Wettlaufer and Earl Johnson did a site review. Numerous violations were noted. They spoke with the owner and his son who said they were going to call the engineer and get back to Howard Fife. An Enforcement Order to cease and desist the work was mentioned and that the DEP would be notified. As it turns out, the corner of Alexander and Allen Hill Rds. is within the Priority Habitat on the maps. It cuts across the parcel. The owners should have filed with National Heritage before going so far. Percs are allowed but with minor impact. The engineer was to visit the parcel and mark the wetlands so we can begin discussions.

7:25 p.m. Lois and Webster Cook of Allen Hill Rd. were curious about the activity on Allen Hill/Alexander Rds. They were informed that the owner gained approval from the Planning Board for an ANR (Approval Not Required). Also, that the engineer was given a copy of the Division of Fisheries and Wildlife officially certifying by the Massachusetts Natural Heritage and Endangered Fisheries program a Vernal Pool located on Alexander/Allen Hill Rds. and that a verbal Cease and Desist had been given.

7:35 p.m. Judith Petit and Tom Cabot, new owner, and Mark Farrell were present at the Petit Public Hearing to repair a septic system at 15 Forest Dr., Map R-5-A-18. Following discussion a motion to accept the project was made. Motion accepted and all parties were in favor of closing the hearing at 7:55 p.m.

8:00 p.m. Julia Rodrigues of Aqua Pool and Patio and Mark Farrell were present at the Batista Public Hearing to build a garage and an in-ground Gunite swimming pool at 449 Mashapaug Rd. (Lot 6). Following discussion a motion to accept the project was made. Motion accepted and all parties were in favor of closing the hearing at 8:20 p.m. Mark Farrell gave us a check for $100.00 paying the Legal Ads for Judith Petit and Christopher Batista. A receipt was given.

Procedure Sheet #2006-1077 issued to John E. Day of 5 Oak Ridge Dr., Map R-10-B-11 to repair a septic system. Present were Michele Day, daughter and Dan Meara who is purchasing the property. Proposed map was reviewed. Motion to accept the plans as presented were accepted and approved by all. Procedure Sheet signed by Mary vandenBerg with the condition that the silt fence must be in place.

8:50 p.m. Tom Baltazar of Sandy Beach Rd. spoke to us regarding his 3 properties – a right of way (right of access) is between 2 of his properties. He was informed that he couldn’t run a pipe across the right of way.

9:00 p.m. Members signed the Enforcement Order, which is to be sent by certified mail to John R. Popolizio, the owner of the property at the corner of Alexander and Allen Hill Rds. A copy will be sent to the DEP.

9:20 p.m. Jack Keogh, Enforcement Officer, was asked to come in. We discussed the need for the Procedure Sheet to be filled out before perc tests and driveways are done, which would assure us that the taxes have been paid.
Motion to adjourn made by Ann Hall, seconded and approved by all. Meeting adjourned at 9:35 p.m.

P.P.S.

Received a Notice of Intent from Sherman and Frydryk, Land Surveying and Engineering for Francis Gregoire of Lot 1B, Wales Rd. who wants to build a single-family house. Check for $262.50 for the Notice of Intent filing fee was included. Concerned parties are to be called to set a Public Hearing date for June 6, 2006, at
7:30 p.m.
